Terms of Service

Welcome to Automately AI. These Terms of Service (“Terms”) govern your access to and use of the Automately AI platform, including our mobile application and website (collectively, the “Service”), operated by Automately AI (“Company”, “we”, “us”, or “our”).

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access the Service.

1. Use of the Service

Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Service. By using the Service, you represent and warrant that you meet this requirement.

Account Registration

You must create an account to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

Acceptable Use

You agree not to use the Service to:

  • Generate fraudulent documents, invoices, or quotations intended to deceive
  • Violate any applicable laws or regulations
  • Infringe upon the rights of others
  • Attempt to reverse engineer, hack, or disrupt the Service
  • Resell or redistribute the Service without authorization
  • Use the Service in any way that could harm our infrastructure

2. Subscription Plans and Billing

Free Plan

The Free plan provides monthly limits across all 6 AI tools: 3 quotations, 3 invoices, 3 resumes, and 5 caption generations per calendar month. Usage resets on the 1st of each month. The Free plan is provided at no charge and may be modified or discontinued at any time.

Paid Plans

Paid subscription plans (Pro at ₱999/mo, Business at ₱1,999/mo) provide unlimited access to all tools. Subscriptions are billed monthly in advance. All payments are processed by PayMongo (cards, GCash, Maya, GrabPay, online banking).

Cancellation

You may cancel your paid subscription at any time. Upon cancellation, you will retain access to paid features until the end of your current billing period. No partial refunds are issued for unused portions of a billing period, except as covered by our refund policy.

Refunds

We offer a 7-day money-back guarantee on paid plans. If you are unsatisfied with the Service within 7 days of your first paid charge, contact us at billing@automatelyai.com for a full refund. Refund requests after 7 days are evaluated on a case-by-case basis.

3. AI-Generated Content

The Service uses artificial intelligence (Claude AI by Anthropic) to generate content including quotation text, invoice notes, and social media captions. You acknowledge that:

  • AI-generated content may not always be accurate, complete, or suitable for every situation.
  • You are solely responsible for reviewing all AI-generated content before using it in your business communications.
  • Automately AI does not guarantee the accuracy of any generated content and is not liable for any decisions made based on AI-generated output.
  • You retain ownership of the content you input and the AI-generated output you produce using the Service.

4. Intellectual Property

The Service, including its design, features, and codebase, is owned by Automately AI and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works of the Service without our explicit written permission.

The content you generate using the Service (quotations, invoices, captions) belongs to you. We claim no ownership over documents you create.

5. Service Availability

We strive to maintain high availability of the Service but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We are not liable for any losses resulting from Service downtime.

6. Limitation of Liability

To the maximum extent permitted by law, Automately AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of or inability to use the Service.

Our total liability to you for any claims arising from your use of the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

7. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will meet your requirements or be error-free.

8. Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms, fraudulent activity, or any other reason at our sole discretion. You may terminate your account at any time by contacting support.

9. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or by displaying a notice in the Service. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

10. Governing Law

These Terms are governed by and construed in accordance with applicable laws. Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration or in the courts of competent jurisdiction.
